TRANSFER CONTRACT  

This contract is put into place to protect Kuttin’ Ups Aussies, and the buyer, from fraud, financial harm, and to protect the health and wellbeing of the animals.  

Purchase Agreement Puppy is under warranty only for the purposes of a companion animal. This warranty does not guarantee breeding or show quality. This includes, size, weight, eye color, coat texture and the like. Buyer releases breeder and agrees to hold harmless for liability any damages to persons or property caused by puppy. Buyer assumes all responsibility and liability for puppy. Breeder cannot guarantee temperament, health and appearance once the puppy has left the possession of the breeder. The buyer must maintain timely and appropriate vet care, vaccinations, heart worm regime and de-worming for the first year of puppy's life. Failure to do so will render this contract void. No refund or transferal for a replacement will be available.   

Deposits A Non-Refunable retainer of $300 is due to reserve your selected puppy along with this signed contract. Retainers can be made through Venmo, Cashapp, Paypal or Zelle. Final Payment is due no later than at the time of picking up the puppy via cash. If using an electronic payment method final payment is due 5 business days before scheduled pick up date.  If receiving your puppy through a transportation service total remaining balance will be due 5 business days before transport is scheduled. Past 7 weeks of age it is at breeders discretion to accept payments in full and transport puppies within a shorter time frame on a case by case basis. Retainers are NON-REFUNDABLE, but are transferable to any later litter if selected puppy does not meet the buyer's liking before 4 weeks of age. After 4 weeks of age if buyer decides to not follow through with the purchase of the puppy the retainer will not be refundable OR transferable. If buyer backs out of puppy after 8 weeks of age no refund will be given for any amount of money received up to that point. Puppy MUST be picked up before 9 weeks of age unless other arrangements have been made with Kuttin’ Ups. Failure to arrange for pickup or speak to Kuttin’ Ups by 9 weeks of age will automatically forfeit any money sent for puppy up to that point.  If puppy is not picked up before 9 weeks of age at buyers request or refusal, a weekly boarding fee will be added to the balance due at $150/week. If buyer requests to leave a tail undocked deposit will be $600 and be non refundable and non transferable. Deposit to leave tail intact has to be done within the first 24 hours of puppy’s birth.   

NOTICE: If at any point money sent through an electronic payment method is reported as spam to your bank or the payment service and returned, this contract will be null and void and this signed contract and evidence against you will be turned over to my attorney. You will be summoned to small claims court for the recovery of the amount for the puppy in your possession plus attorney fees and grievance fees.   

Health Warranty Buyer accepts and agrees that the breeder warranties puppy to be in good health and free of genetic defects. If any defects are present at time of transfer, buyer agrees they have been made aware of the issues and they will not be covered by this warranty. Breeder offers a one year warranty on every puppy, without monetary value. A genetic health guarantee does not cover infectious or communicable diseases such as parvo, giardia, coccidiosis and the like. Under no circumstances is breeder liable for any and all communicable diseases. Buyer agrees to provide proof of a professional and licensed Veterinary examination for general health, within 72  hours of delivery/pickup, with a signed statement of health. Failure to do so will void this contract, and deem the breeder not liable for any and all complications, health issues. If puppy does not pass a general health exam due to genetic defect, buyer agrees to notify breeder within 48 hours and provide a copy of the signed statement from a licensed vet within 48 hours of examination. Breeder ensures that every effort is made to prevent minor treatable problems such as but not limited to diarrhea, coccidiosis, giardia, parasites, etc. It is understood that these are common issues especially under stress of new circumstances for the puppy, and will not be covered by the health warranty. Buyer agrees that the breeder is not responsible for buyer's veterinary expenses at any time or under any circumstance.  

If the dog has a cosmetic defect such as but not limited to a hernia, or any condition that is not life threatening, such condition is not covered by this warranty.   

Puppy is guaranteed up to 1 year of whelping date against any crippling hip dysplasia, genetic eye deformity, or other genetic disability. Buyer must present evidence of this to the seller by a professional and licensed Veterinarian and it is at the breeder’s discretion to get a second opinion from a Veterinarian of their choosing before moving forward. Kuttin’ Ups will then replace the dog with one of the same sex and color coat and size within one year. If the buyer chooses to keep the animal, it must be spayed or neutered at the buyer's expense and proof sent to Kuttin’ Ups before a replacement will be given.  

AT ANY TIME, FOR ANY REASON, BUYER CANNOT OR WISHES TO NOT CARE FOR  

THIS PUPPY, THE BUYER MUST CONTACT THE BREEDER FIRST TO OFFER THE  

PUPPY BACK. THE BREEDER WILL ALWAYS ACCEPT THE PUPPY BACK. UNDER NO 

CIRCUMSTANCES WILL THE BUYER SEND THE PUPPY TO A SHELTER OR RESCUE SERVICE.   

By signing this contract, the buyer agrees to all terms and conditions and that this dog is not sold for resale purposes, and the breeder will be notified if it is necessary for the dog to change hands, and first right of refusal will be given to the breeder.
